Terms and Conditions

These Terms and Conditions ("Terms") govern your use of https://tracksheets.kutter.li (the "Service") and your purchase of digital content ("Tracksheets"). By creating an account or making a purchase, you accept these Terms.

1. Operator

2. The Service

The Service is an online library of precision racing-line diagrams ("Tracksheets") for racetracks worldwide, intended for personal use by trackday riders and drivers. Sheets are sold individually or as credit packs.

3. Eligibility and accounts

To register and purchase, you must have the legal capacity under Swiss law to enter into binding contracts. If you are a minor, you confirm that you have parental or guardian consent.

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

4. Prices, payment, and VAT

Prices are shown in Euro (EUR) and are total prices. If VAT or other taxes apply, they are included in the displayed price.

Payment is processed by Stripe. By submitting an order you authorise the charge.

Credits, once purchased, do not expire.

5. Conclusion of contract

The display of products on the Service is an invitation to make an offer. Your order is an offer to purchase. The contract is concluded when we confirm the order by email or by making the content available for download, whichever is earlier.

6. Delivery

Tracksheets are delivered as digital downloads from your account dashboard immediately after payment is confirmed. Delivery is electronic only; no physical media is shipped.

7. Right of withdrawal — express waiver for digital content

You acknowledge and expressly agree that, by initiating the download of a purchased Tracksheet, performance of the contract begins before any cooling-off or withdrawal period would expire, and you thereby waive any right of withdrawal or cancellation to the extent legally permitted.

This corresponds to the rule in EU Directive 2011/83/EU Art. 16(m) for digital content supplied on a non-tangible medium, where the consumer has given prior express consent and acknowledged that the right of withdrawal will be lost.

This waiver does not affect your statutory rights in the case of defects (see § 9).

8. Licence

We grant you a personal, non-transferable, non-exclusive, non-commercial licence to the purchased Tracksheets, limited to:

  • viewing the sheet on your own devices,
  • printing one or more copies for your own personal use, and
  • using the sheet in coaching that you receive or give in person, provided the sheet is not reproduced, redistributed, or made publicly available.

You may not:

  • resell, rent, sublicense, or transfer the sheet to another person;
  • upload it to public platforms, file-sharing services, or social media;
  • use it for commercial reproduction, merchandise, or publication;
  • remove or alter copyright notices or watermarks.

All Tracksheets and all elements of the Service (text, graphics, code, design) remain the intellectual property of Martin Kutter or the named contributors. No rights are transferred beyond the licence stated above.

9. Defects and goodwill refunds

If a downloaded Tracksheet is defective — for example the file is corrupt, unreadable, or substantially different from what was described — contact us at info@tracksheets.com within a reasonable time. We will, at our discretion, provide a working replacement file, credit your account, or refund the purchase. This is in addition to your non-waivable statutory rights.

Refunds are not granted simply because you changed your mind after downloading.

10. Acceptable use

You agree not to:

  • use the Service in violation of any applicable law;
  • attempt to circumvent payment, access controls, or technical protection measures;
  • attempt to scrape, mass-download, or reverse engineer the Service;
  • use the Service to distribute malware, phish, or harass others.

We may suspend or terminate accounts that violate these Terms.

11. Availability and changes

We strive to keep the Service available 24/7 but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue parts of the Service with reasonable notice.

12. Liability

To the extent permitted by Swiss law, our liability is limited as follows:

  • We are liable without limitation for damages caused by gross negligence or intent and for personal injury.
  • For slight negligence, our liability is limited to typical, foreseeable damage and capped at the amount you paid for the affected order.
  • We are not liable for indirect or consequential damages, lost profits, or loss of data, except as required by mandatory law.
  • Tracksheets are reference material; you are solely responsible for your own safety on track, your riding or driving decisions, and compliance with the rules of the circuit you visit.

13. Account termination

You may delete your account at any time from your account settings or by writing to info@tracksheets.com. We may close accounts that have been inactive for an extended period or that violate these Terms. Already-purchased content remains accessible for download for a reasonable period after account closure, unless legally restricted.

14. Changes to these Terms

We may amend these Terms. The current version is published on the Service with the "Last updated" date. For material changes, we will notify registered users by email. Continued use of the Service after the changes take effect constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules.

Exclusive place of jurisdiction is Gossau ZH, Switzerland, to the extent permitted by law. Consumers domiciled in the EU/EEA retain any rights to invoke the mandatory law and courts of their country of residence.

16. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions remain in force. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
